Acceptance of General Terms

All purchase orders submitted by our customers are assumed as accepting our Terms and Conditions as stated herein.

Freight Terms

Shipments and deliveries shall at all times be subject to the approval of Omega Sales & Marketing (“Omega”).
Unless otherwise stated, all shipments are F.O.B. Omega’s warehouse in Langley, BC.
Customers may inquire about shipping collect with their preferred carrier.
It is the responsibility of the customer when signing for deliveries to make sure the product is free from visible damage prior to signing or such damage/shortage must be noted in writing with the freight carrier before accepting shipment.  Otherwise, Omega’s customer service will assist the customer in filing the freight claim for reimbursement from the carrier but any possible loss will be incurred by the customer.

Price

Our prices are subject to change without any prior notice.  Unless otherwise stated, prices quoted do not include freight, insurance, import duties, taxes or governmental fees, impositions or assessments, all of which shall also be billed to and be paid by the buyer.  Any increases or additions in the foregoing charges imposed by law, regulation or governmental action following the seller’s quotation or confirmation of prices shall also be paid by the buyer.

Backorders

Unless otherwise noted on an order acknowledgement, all orders to Omega are deemed cancelled if items are not available to be shipped.

Warranty

Products sold by Omega are warranted to be free from defects in material and workmanship under the normal intended use of the product and service for a period of 1 year from the date of purchase. Many of the products that we sell carry a manufacturer's warranty that extends beyond this 1-year period.  All manufacturers’ warranty policies supersede Omega’s Policy.
Our warranty does not cover any product or part, which has been subjected to misuse, negligence, or accident, nor does it cover any product that is used for any purposes other than that for which it is intended as stated in the specific manufacturer's product information.
Driver bits, nut setters and holders are guaranteed against manufacturers defects only as they are consumable goods.
Buyer shall immediately notify Omega of any defect.   No goods may be returned collect without the seller’s written consent.  Please send your request to fax: 604 607 0629 or e-mail:  omegasales.orders@gmail.com.  We will advise you of terms and disposition of the product along with a Returned Merchandise Authorization (RMA).

Satisfaction guarantee:

Omega guarantees your complete satisfaction!  If after receiving and inspecting your purchase you are not totally satisfied, and the product is still in the original packaging unused, simply return the merchandise to us within 30 days of ordering, shipping prepaid, for a full refund of your item's purchase price less freight. There is no restocking charge within the 30 days, unless it is a special order item from the manufacturer that is not normally stocked in our warehouse.  Delivery charges are not refundable. The returned merchandise must be new, complete, and in its original packaging. We cannot issue a credit or refund for any product which is returned to us that has been used or altered, or has any missing parts or packaging.

Liability

Omega’s liability shall be limited solely to providing replacements or refund for defective or nonconforming goods.  Omega shall not be liable under any circumstances for any punitive, special, incidental, consequential, direct or indirect damages incurred by the buyer or anyone claiming through the buyer, except to the extent that such exclusion or limitation is not allowed by applicable law.  Omega shall at no time be liable for a claimed breach of this agreement in an amount exceeding the stated price of the affected goods.

Force Majeure

Omega shall be excused for any delay or failure in performance due to any circumstance or cause beyond the control of Omega in the reasonable conduct of its business.

Product Availability

Listed items are generally available or expected to be available soon; once the items you ordered are in stock, we'll package and ship them to you.  You will be notified immediately by an Omega representative if one or more of the items that you have ordered is not available.
